Start with dated photographs from your own side, taken at the same spot each month through the growing season. Note where canes appear on your land, how far from the boundary they are and whether they push through paving, a fence base or a shed floor. Keep every message you send or receive. A survey adds measurements and a professional opinion, which carries more weight than your own photos alone.
Most neighbours do not know they have it, and many are as worried as you are. Begin with a friendly note or a chat over the fence, and offer to share the survey findings. If the house is rented, the landlord or agent is the right person to contact. If the stand is on an empty plot or a railway bank, work out who owns it before you write to anyone.
Give it a few weeks, then follow up in writing and keep a copy. If the neighbour will not engage, your record, the survey and your written requests are what you would show if you later take advice from a solicitor. Check whether your home insurance includes legal expenses cover. In the meantime, do not spray or dig beyond your own boundary, and do not enter their land without permission.
